Executive Manager: Legal and Contracts Management

The Wholesale and Retail Sector for Education and Training Authority (W&RSETA) seeks to employ an Executive Manager: Legal and Contracts Management, who will report directly to the Chief Officer: Corporate Services and be based at the Head Office in Centurion.

Key Performance Areas will include but not limited to the following;

 Formulate and lead the implementation of the Legal Support Services and Contracts Management Frameworks
 Provide legal advice and support to the SETA on substantive and complex legal issues with potential serious legal and financial implications
 Analyse the current legal and contract management approaches and implement viable strategies
 Provide legal advice and/or opinions to the Board and management on legal and contract matters
 Interpret situation and contextual issues and provide research to enable preparation of legal and contract documents
 Prepare and manage the SETA’s legal documents and provide interpretations of legal information
 Review and provide legal advice on tender documents
 Review ongoing cases and advise management by ensuring that the timelines and prescripts set by the legislation are adhered to
 Advise and prepare relevant agreements regarding the delegation of powers and employment contracts on behalf of the SETA
 Create awareness on legal and contract matters
 Oversee contracts management and ensure regular reviews of the contracts register
 Lead the Unit and ensure that the strategies and plans support the SETA’s business strategies
 Provide strategic leadership of an effective Risk Management Strategy of the Unit
 Streamline all internal legal and contract operations and help optimize their strategic benefits
 Lead the development of a legal and contract management platform to serve the SETA
 Liaise with the relevant Units to ensure that where legal and contract risks have been identified, appropriate courses of action have been taken
 Compile monthly, quarterly and external reports
 Build and maintain strategic partnerships with relevant organisations and institutions, including other SETAs
 Represent the SETA at forums
 Provide legislative analysis and support to the SETA and render the required strategic leadership on compliance oversight
 Ensure that the Board / management / business units comply with all applicable legislation
 Review and advise management on the legal implications of internal policies and procedures
 Review and draft contracts, agreements and internal policies and ensure that these are in compliance with all statutory or legal requirements
 Provide leadership in respect of financial management as per the PFMA and any other relevant government policies
 Uphold and lead good corporate governance within the Unit
 Lead and manage the Unit to achieve set goals and target within set timeframes
 Build and maintain an effective team within the Unit
 Implement the best performance management practices, coaching and mentorship methods
 Create and maintain a culture of performance and efficiency

Job Requirements: 

Minimum Qualification and Experience:
 Matric / Grade 12 National certificate;
 Bachelor’s Degree in Law (LLB)
 Admission as an Advocate or Attorney
 8 years’ experience in legal and contracts management
 5 years’ experience in a senior management position
 In-depth knowledge and understanding of the legal and contracts management frameworks
 Understanding of legislation research and development methodologies
 Solid understanding and experience of regulations and protocols in the public sector
 Strong analytical skills and an ability to diagnose complex problems
 Experience in a SETA/Public Sector environment will be an advantage
 Own transport and a valid Driver’s License

 Understanding and knowledge of corporate governance principles and legislation including but not limited to Companies Act and King III Report
