Senior Manager: Legal Services

The Construction Education and Training Authority (CETA) exists in terms of the Skills Development Act and is a categorised as a Schedule 3A public entity in terms of the Public Finance Management Act (PFMA). Its mandate includes:

• Developing and implementing a sector skills plan
• Promoting learning programmes
• Registering learning programme agreements
• Serving as an Education and Training Quality Authority
• Collecting and disbursing skills development levies
• Liaising with the National Skills Authority
• Reporting to the Director-General of the Department of Higher Education and Training on its activities

The CETA would like to make the following appointments on a fixed-term contract up to 31 March 2020, renewable at its discretion:

Senior Manager: Legal Service
Reporting to the Executive: Chief Executive Officer
Based at Head Office in Gauteng
All-inclusive salary package negotiable

Job Profile:
The CETA is regarded as both an organ of state, as provided for in terms of section 239 of the Constitution of the Republic of South Africa 1996 (“Constitution”), as well as a national public entity identified in Schedule 3 of the Public Finance Management Act 1 of 1999 (“PFMA”).
• As such, and form a governance perspective, the CETA is regulated primarily by:-
• The Constitution;
• The Skills Development Act No. 88 of 1998;
• The Skills Development Act, Act No 9 of 1999;
• Preferential Procurement Policy Framework Act, Act 5 of 2000;
• The PFMA;
• National Treasury Regulations

Minimum Requirements for the Position
• A three year university degree or equivalent qualification, in LLB or LLM, or related field
• Admitted Attorney
• A minimum of 10 years working experience in litigation of which a minimum of 5 must have been in a management role
• A relevant postgraduate qualification, or evidence of study towards one, would be an
• added advantage
• At least two years demonstrable experience in a supervisory capacity
• Above average understanding of the South African skills development environment

Duties and Responsibilities
• Develop and implement Departmental strategy and plans
• Development and implementation of Departmental related policies and procedures
• Development and management of relevant databases within the organisation
• Management and capacitation of the Departments staff
• Ensuring CETA compliance with policy, legislative, regulatory and reporting requirements
• Ensure the development and responsible management of the Department budget
• Develop and review the department policies, processes and procedures
• Represent the CETA in and/or make inputs into relevant structures and forums both inside and outside the organisation
• Conduct regular benchmarking exercises for internal quality promotion
• Ensure organisational risk management from the Unit’s point of view
• Support stakeholders towards compliance with the CETA’s policies; processes and procedures; rules and regulations; and legislation pertaining to the unit
Provision of legal services
• Provide strategic and operational legal support
• Ensure that legal services operate efficiently and effectively by being aware of the legal instruments, whether legislation, regulation or otherwise, which apply uniquely to the CETA
• Provide advice, guidance and opinions in relation to the regulatory documents / environment applicable to the CETA with specific reference to the regulatory documents
• Ensure that the best possible legal land commercial course of action is adopted / implemented in relation to the resolution of legal dispute such as arbitration and conciliation
• Provide legal advice on the interpretation of the Statutes and their implications to the CETA
• Ensure that the CETA is kept up to date insofar as the changing CETA landscape is concerned from a legislative and regulatory perspective
• Provide opinions
Provision of litigation services
• Manage all aspects of all litigious matters
• Manage and provide representation at the CCMA and Labour Courts
• Attend to the briefing service providers and counsel in relation to specialised matters
• Assist / or guide the CETA in relation to the litigation process
• Ensure proper support for and in respect of litigious matters.
• Manage costs
• Manage outcomes
Setting up and management of a contracts management capability in the organisation
• Provide assistance and support in the negotiation of contracts
• Provide advice in the drafting of various or specialised contracts
• Provide advice on the drafting of SLA’s MOU and MSA’s etc.
• Manage the ADR process in relation to contractual matters
• Provide legal opinions on the various contractual matters
• Vetting of contracts
• Support during SCM Process – e.g. Review committees. Ensuring the contracts are concluded in accordance with the provisions of the PFMA and the PPPFA
Legal Administration
• Ensure compliance in respect of all governance standards and requirements including the regulatory documents
• Ensure the Department operates efficiently and effectively within the ambit of the regulatory documents which serve to regulate the regulatory framework applicable to the CETA
• Attend to the drafting / development of and ensuring compliance with the legal registry for the CETA being the regulatory requirements applicable to the CETA
People Management
• Provide induction and orientation
• Provide capacity building, through training, coaching and development of direct reports
• Ensure that employees have clear work expectations and goals
• Ensure attendance of staff
• Manage the discipline of employees in the Department and if applicable the CETA when instructed to
• Perform any other relevant duties as directed
